Lots of exciting things happening here.  Our members are actively involved in making The OLP the center of higher continuing legal education and we give them the highest marks possible!

This summer, we launched The OLP's eDiscovery online, interactive courses.  The third one, eDiscovery for Techies starts August 30th.  Don't miss out!

The OLP eDiscovery Certification Exam                                                                
Coming October 15th
Success FailureWe're getting close!  The OLP eDiscovery Certification Exam is almost here.
Designed in a corporate sponsorship by professional instructional designers with content provided by The OLP's certification exam committee, we are getting ready to launch the first eDiscovery Certification exam.  Scheduled to launch October 15, the exam will be given in over 1,000 secured environments across the U.S. and abroad.

The exam will cover 7 areas including substantive law, technology and procedures. Candidates for the exam must submit an application form for approval.

The Latest Trends in eDiscovery Cost Reduction:  Litigation PreNups & Mediation

Editor: What are some of the newer ideas about cost and risk reduction in e-discovery? Mack: I think we're all aware of the efforts that will culminate in the Duke Conference to change the Federal Rules. If I could sum up Duke, it would be in the phrase "Campaign for Proportionality."

 We as service providers to our clients see the pressing need to control outsized e-discovery costs and feel that formalizing proportionality is the best way to achieve this. It is clear that e-discovery has to be more in line with the value of a particular case. The other cost control efforts that are new on the horizon relate to mediation and arbitration.
 
Mediation and arbitration have been around for a long time, but they have not been applied on a large scale to e-discovery disputes. I'll talk a little bit later about why these particular tools have immense utility in risk and cost reduction. I'd also like to talk later about an interestingly titled solution called a "litigation prenup" that allows businesses to limit their e-discovery and other litigation exposure by contract. Triaging Foreign Language Documents

One of the many complications encountered with litigation involving international parties is dealing with large volumes of foreign language documents. Typical approaches range anywhere from asking ones international client for translation support, hiring bilingual reviewers to the case team, using Machine Translation (MT) to translate all of the documents and outsourcing documents for full translation.

There are advantages and limitations of each of the above. The critical process of cross lingual concept searching and categorization should be run in advance of any translation or review in order to reduce the volume of documents (and costs associated with that effort).

Asking clients to provide staff for foreign language document review and translation support: This is a very good option if your international client has staff to spare. Client's employees will already have some unique understanding as to their employers products and services, industry unique nomenclature and perhaps some idea as to the issues in question. At least some of these employees will need to be bilingual with good command of English in order to communicate well with the case team. It's less likely that these people will be trained in US law so the roles would be limited to that of helping case team identify potentially responsive/relevant documents for the US case team to evaluate.  READ MORE



Forget Your Inner Child! In These Tough Times, Bring In Your Inner Chutzpah

Over lunch, my agent posed a provocative challenge:  "Write an article on chutzpah."  He believes the timing is right.  In this difficult economy
and uncertain times it's certainly tempting to withdraw into a shell.  But a better strategy might be a contrary one, throwing off the shell and putting yourself out there. 
 
One "chutzpah" source involves productively tapping into what I call the "RAGE" in "Out-RAGE-ous."  (And these days, there's plenty to be enraged about!)   Try harnessing some aggressive energy and attitude -- develop an "out of the box" presence if not an edgy essence.  (Remember, if you're not living on the edge you are taking up way too much space!)

Actually, the word itself has become double-edged.  According to Wikipedia, "chutzpah" derives from the Hebrew, and connotes "insolence", "audacity", and "impertinence."  However, "the modern English usage of the word has taken on a wider spectrum of meaning...with even positive connotations.  Chutzpah can be used to express admiration for non-conformist but gutsy audacity

Hollywood had created an illusion of intrigue, suspense, passion and the notorious tug of war wherein good triumphs over evil, the big company crumbles, children are saved, the mother dies to protect them and Erin Brockovich gets a big fat check.

The OLP seeks p/t instructors for Litigation Support, Trial Tech and eDiscovery Courses
 

The OLP is seeking instructors for three new online, interactive litigation support courses:  Litigation Support 101A; Advanced Litigation Support and Project Management for Legal Professionals.  The courses start in October and go 8 weeks meeting one or two times per week.

We are utilizing a state-of-the-art software program where instructors and students will be able to see one another.  The three courses will be team-taught.
