This workshop begins with a discussion of attorneys’ responsibilities under the ABA Model Rules of Professional Conduct. The conversation shifts to the benefits and ethical considerations of the advanced technologies now available to litigators.

The presentation covers a wide range of topics raised by developments in legal technology:

  •      Basic foundation of client representation
  •      Whether attorneys have an affirmative duty to apply technology
  •      Working with service providers

    Deposition technologies and related ethical considerations:

  •   Videotaped depositions
  •   Realtime, both standard and Internet
  •   Remotely-conducted depositions
  •   Electronic communications during depositions
  •   Social networking such as Facebook, MySpace and Twitter.
  •   Online evidence repositories
