Litigation Holds
Since the beginning of 2010, four notable cases have been issued in U.S. District Courts that have featured litigation holds prominently. Courts are putting an unprecedented level of scrutiny on the legal hold procedures and issuing strong sanctions ranging from compelling further discovery, cost shifting, fines, special jury instructions, preclusion and even default judgments.
This webinar helps you avoid sanctions due to improper legal hold notifications and shows you how to establish a defensible audit trail. Some of the topics covered are:
- Issuing a Litigation Hold Notice
- Identifying the IT and records management personnel and others who can assist in protecting and preserving ESI and other relevant information
- Identifying categories of information that are to be preserved and
- Conducting a proper custodian interview to facilitate the location of ESI.

Julie Wade has gained substantial experience managing discovery in litigation in state, federal and multi-jurisdictional courts of law. She is a published author and presenter on topics of electronic discovery, business intelligence and enterprise content management issues.
Ms. Wade received her Paralegal Certificate from the University of North Texas and is a member of the State Bar of Texas Paralegal Division. She received her Certification in Electronic Discovery from Kroll Ontrack and an Advanced Certification in Electronic Discovery from Kroll, earning her the designation of Certified Electronic Discovery Specialist.
Daniel Lim is a Senior Director and Assistant General Counsel for Guidance Software, Inc. Daniel consults with both corporate and public sector clients on eDiscovery and digital investigation issues. He speaks reg
ularly on developments following the changes in the Federal Rules of Civil Procedure pertaining to electronically stored information and best practices in preparing for and responding to discovery requests.
Prior to joining Guidance Software, Daniel was an attorney at Jones Day, practicing commercial litigation and defending major energy companies in government investigations. As a member of the firm’s eDiscovery committee, he oversaw the collection, review and production of electronically stored information.
Daniel is a graduate of Columbia Law School and former law clerk to the Honorable Vanessa Gilmore, U.S. District Court, Southern District of Texas. He also practiced commercial litigation at Beck, Redden & Secrest and McGlinchey Stafford.
